Providing damages expert witness services in construction & engineering disputes

Our experts are regularly instructed and give evidence in construction and engineering disputes under arbitration proceedings.  We have experience of working on projects globally, both in relation to investment treaty claims acting for and against the state, and in commercial and contractual disputes between companies.

Whether it be delays in the development of mines, consequential losses from the delay of property development or losses arising from aborted construction projects, we provide specialist expertise in evaluating wasted costs and the valuation of historical and future losses.

Our recent cases include:

  • Appointed to quantify lost profit and wasted costs in a USD 800 million claim for fraudulent misrepresentation in Swiss and ICC arbitrations over the development of a mine in Russia.
  • Engaged by the claimant in a LCIA arbitration relating to a construction company in an East African country and the damages caused by an alleged government expropriation.
  • Assisted an Eastern European government, to assess the quantum aspects of wasted costs and loss of profits claims in an ICC arbitration involving the construction and maintenance of a tolled highway which was terminated at an early stage.
  • Valuation of a property development business in Russia in a dispute between joint venture partners in a claim following delays to the construction of the development.
